TERMS OF SERVICE

Another Path Ministry

Effective Date: 1 August 2025

0. Your Acceptance

By visiting anotherpathministry.org (the “Site”) or taking part in any in‑person or virtual activity of Another Path Ministry (“Ministry,” “we,” “us”), you (the “user”) agree to be bound by:

1. These Terms of Service (“Terms”);

2. Our Privacy Policy;

3. Our Code of Conduct; and

4. Our Member Disclaimer (collectively, the “Policies”).

If you do not accept every Policy, do not use the Site.

1. Nature & Tax Status

Another Path Ministry is an Arizona nonprofit religious corporation recognized as a § 501(c)(3) public charity (EIN fill‑in). Donations may be tax‑deductible—consult your tax adviser.

2. Eligibility & Age Limits

  • The Site and community spaces are intended for individuals 18 or older.

* Teens 13–17 may participate only with verified parental/guardian consent.

* No Ministry entheogen discussion or ceremony is open to minors.

(Updated in light of the FTC’s January 16 2025 COPPA rule changes that heighten parental‑consent and security duties. Akin - Akin, an Elite Global Law Firm)

3. No Medical, Legal, or Therapeutic Advice

Content and activities are spiritual/educational only. We do not diagnose, treat, or cure any physical or mental condition. Always consult qualified health‑care or legal professionals.

4. Entheogens & Sacraments

The Ministry reveres certain plants and substances (“entheogens”) as sacramental, but:

  • No distribution. We do not grow, manufacture, sell, or procure controlled substances.

  • Legal compliance. You must obey all U.S. federal, state, and local drug laws. Psilocybin remains a federal Schedule I substance; recent Arizona proposals (e.g., SB 1555, SB 1570) have not legalized natural mushrooms and only contemplate FDA‑approved synthetic formulations. Reason Foundation

  • Personal responsibility. Use of any entheogen is your voluntary, informed decision. You assume all legal, physical, and spiritual risk.

5. Code of Conduct & Community Safety

You agree to uphold the Code of Conduct (personal sovereignty, consent, respect, confidentiality, legal integrity). Violations may result in immediate removal and membership termination with no refund.

6. User‑Generated Content & DMCA

If you post comments, photos, or other material (“UGC”):

  • You grant the Ministry a non‑exclusive, worldwide, royalty‑free license to use, reproduce, and display your UGC in connection with the Site.

  • We may remove or refuse UGC at our sole discretion.

  • DMCA notices for alleged copyright infringement: email dmca@anotherpathministry.org with the information required by 17 U.S.C. § 512.

7. Payments, Donations & Refunds

  • Donations support our nonprofit mission and are non‑refundable.

  • Physical merchandise may be returned unused within 30 days for a refund of the item price (shipping non‑refundable).

  • Digital services/events are non‑refundable once delivered or attended.

8. Intellectual Property

All Site content—including text, graphics, audio, video, and guided meditations—is © Another Path Ministry or its licensors. No reproduction or derivative works without written permission.

9. Warranty Disclaimer

The Site, content, and services are provided “as is” and “as available,” without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, accuracy, or non‑infringement).

10. Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising out of these Terms will not exceed the greater of US $100 or the amount you paid us in the 12 months before the claim. We are not liable for indirect, special, incidental, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold harmless the Ministry, its directors, officers, volunteers, and affiliates from any claim or demand arising out of your use of the Site or violation of any Policy.

12. Dispute Resolution & Governing Law

  • Governing Law: Arizona law (without regard to conflicts‑of‑law rules).

  • Venue: State or federal courts located in Coconino County, Arizona, unless both parties agree to binding arbitration under the Federal Arbitration Act with an approved provider.

  • You waive any objection to personal jurisdiction and venue in those courts.

13. Severability, Assignment & Entire Agreement

If any provision is unenforceable, the rest remain in force. We may assign our rights; you may not. These Terms (plus the Policies) constitute the entire agreement between us.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be posted 30 days before taking effect. Continued use after the effective date equals acceptance.
